1. Cookie definitions and characteristics
Cookies and similar technologies are information that websites and apps send or read on user devices on his first visit, to be later retransmitted when the user returns on the same website or app. Thanks to cookies, websites and apps remember user’s actions and preferences (such as login data, chosen language, font size, other display settings, etc.) so that they do not have to be re-indicated when the user returns to visit said site or browse from one page to another.
These technologies, cookies or similar, are used to perform computer authentication, monitoring sessions and storing information regarding the activities of users accessing a site, and may also contain a unique identification code that allows for tracking the user’s navigation within the site itself for statistical or advertising purposes.
Different types of cookies exist, depending on their features and functions, and they might be stored on the users’ devices for different timeframes: session cookies are cancelled at the end of each browsing session, while persistent cookies may last up to a certain date that has been pre-set by their owner.
In accordance with the applicable law, user’s consent to the latter is not always requested. In fact, the consent is not required for “technical cookies”, e.g. those used with the only purpose of sending communications over an electronic communication network, or those strictly necessary to provide services expressly required by the user. In other words, cookies are indispensable to site operation.
User’s prior consent is, in fact, required for non-anonymous cookies aimed at profiling users (analytical cookies), e.g. those providing statistic analysis on the use of a site or profiling users in order to send ads in line with the preferences shown by the user during navigation.
